Intent

Section 164A of the Data Protection Act 2018 gives the person a right to complain to the organisation itself. It is the quicker route, and the response is where they would learn it exists.

How to test it

An assessor scores the criterion against a single response:

Score 2
The response gives the person a route for complaining to the organisation, and says how to use it.
Score 1
The response says the person can complain without saying how, or gives only a general enquiries address.
Score 0
The response says nothing about complaining to the organisation.
