A Charge or Rejection Justified
Where the organisation charges a fee, or rejects the request as manifestly unfounded or excessive, the response states why.
Intent
Manifestly unfounded and excessive are narrow tests, and a fee is narrower still. Both are open to abuse where the organisation is not made to say why it reached for them.
How to test it
An assessor scores the criterion against a single response:
- Score 2
- The response says why the organisation treated the request as manifestly unfounded or excessive, or why it charged a fee.
- Score 1
- The response asserts that the request was excessive, or that a fee applies, without saying what led to that.
- Score 0
- The organisation charged a fee or rejected the request without saying why.
- Not applicable
- The organisation neither charged a fee nor rejected the request on those grounds.

This criterion reflects Article 12(5) of the UK GDPR. That mapping is a guide, not a legal test: conformance is judged against the criterion, not the article.
