The Right to Complain
The response states that the person can complain to the Information Commissioner's Office.
Intent
The right to complain to the regulator is the person's route to a remedy when the response falls short. It is worth least to the person who does not know it exists.
How to test it
An assessor scores the criterion against a single response:
- Score 2
- The response names the Information Commissioner's Office as the place to complain.
- Score 1
- The response says the person can complain to a regulator, without naming which one.
- Score 0
- The response says nothing about complaining to a regulator.
The law it reflects
This criterion reflects Article 15(1)(f) of the UK GDPR. That mapping is a guide, not a legal test: conformance is judged against the criterion, not the article.
See E6 in context in the full standard.
